Terms of Service for Ticketwhat.co.uk

§ 1 General Provisions

  1. These Terms of Service (hereinafter: "Terms") define the rules for using the Ticketwhat.co.uk website (hereinafter: "Service") by Users, containing in particular information about flight ticket offers, as well as the rules for providing intermediary services in their purchase.
  2. The Service Provider within the Service is Ticketwhat Sp. z o.o. (hereinafter: "Service Provider") with its registered office at ul. Frezerów 3, 20-209 Lublin, entered in the National Court Register under KRS number 0000809810 and having NIP tax number 9462692646.
  3. Contact with the Service Provider is possible via email at [email protected] or by post to the correspondence address: Ticketwhat Sp. z o.o., ul. Frezerów 3, 20-209 Lublin.
  4. Acceptance of the Terms is voluntary, but necessary to use the services provided by the Service Provider.
  5. Use of the Service is possible provided that the User's IT system meets the following minimum technical requirements:
    1. computer or mobile device with internet access,
    2. current version of a web browser, including Google Chrome, Firefox, Safari, Edge or Internet Explorer,
    3. access to email and an active email address,
    4. application enabling reading of PDF files.
  6. The Terms use the following concepts, which should be understood as follows:
    1. Website – main page Ticketwhat.co.uk and its subpages;
    2. Notification – electronic message sent to the User's email address provided when filling out the registration form or booking form in the Service, containing specific information;
    3. Provider – provider of services offered to the User through the Service;
    4. User – natural person, legal person or organizational unit without legal personality, to which separate regulations grant legal capacity, intending to use or using the Service Provider's services by filling out the registration form or booking form;
    5. Intermediary Agreement – agreement concluded between the Service Provider and the User, the subject of which is the provision of Intermediary Service;
    6. Intermediary Service – service performed by the Service Provider through the Service for Users, consisting in the Service Provider's intermediation in the purchase of services by the User from Providers through the Service, for which the Service Provider charges a Service Fee;
    7. Service Fee – non-refundable fee charged by the Service Provider for providing the Intermediary Service through the Service.

§ 2 Using the Service

  1. Using the Service means accepting the conditions specified in the Terms.
  2. As part of the Intermediary Service, the Service Provider acts as an intermediary performing factual activities with Providers, related to the purchase and delivery of tickets ordered from Providers in accordance with the User's instructions, on behalf of and for the benefit of the User. The provision of services and handling of complaints takes place based on the general terms of Providers specified in these Terms or during the booking process.
  3. The moment of concluding the Intermediary Agreement is the moment of properly filling out the booking form available in the Service and clicking the "Book" button.
  4. Making a booking means the User's acceptance of the terms of service provision offered by the Provider. The terms of all airlines available in the Service can be found at: Airline Transport Conditions
  5. After making a booking in the Service, the User is obliged to make payment immediately.
  6. After payment is credited, the Service Provider immediately proceeds to implement the intermediary service in the scope of booking.
  7. The Service Provider ensures that it will exercise the utmost care in terms of reliability, timeliness and completeness of the content of offers published in the Service, however, it reserves that due to the dynamic nature of changes in airline price lists, some offers may be outdated. The Service Provider is not liable for any losses or damages incurred by the User as a result of inaccurate or incomplete information.
  8. In case the Service Provider finds an error in the price or offer, the Service Provider reserves the right to cancel the booking or – if the User agrees – change the price. In such situation, we will contact the User.
  9. After completing the intermediary service, the User will receive a Notification with confirmation.
  10. The price proposals and forecasts presented in the Service are for informational purposes only and do not constitute a commercial offer:
    1. The Service Provider makes every effort to ensure that the presented information is current and objective;
    2. Due to frequent changes in the offers of external service providers, the presented data may be periodically outdated and/or averaged;
    3. These elements in the Service are only intended to approximate price trends of selected tourist services.

§ 3 Liability

  1. The Service Provider is not liable for content published in the Service by Users.
  2. The Service Provider is not liable for damages resulting from the use of the Service by Users in a manner inconsistent with the law or the Terms.
  3. Data provided by the User when using the Service, including in the booking process, must correspond to real data, in particular contained in an identity card or passport. The Service Provider is not liable in case of failure to provide them or providing incorrect data.
  4. When making a booking, the User should verify having appropriate and valid documents, certificates or insurance enabling travel, as well as familiarize themselves with regulations and restrictions related to entry to countries covered by the trip.

§ 4 Information for Consumers

  1. In accordance with the Consumer Rights Act, a User with Consumer status has the right to withdraw from a distance contract, without giving reasons, within the statutory period of 14 days from its conclusion; however, the right to withdraw from a distance contract does not apply to contracts for the provision of services, if the service has been fully performed, and its commencement took place with the prior express consent of the consumer and after informing them by the service provider about the loss of the right to withdraw from the contract after its full performance.
  2. The Intermediary Service is implemented after the User expresses the will to use it, so it may be performed before the expiry of the withdrawal period. In such case, the User does not have the right to withdraw from the contract from the moment of service performance. If Providers provide for the possibility of refunding part or all of the value of services, the User will be informed about it.

§ 5 Payments

  1. After making a booking through the Service, the User makes payment for the booking amount indicated during the finalization of the booking process in the Service.
  2. Payments are made through the fast online transfer operator indicated during booking finalization.
  3. The booking is considered paid from the moment the Service Provider receives confirmation of payment crediting from the payment operator.
  4. When using the Service, the User cannot:
    1. use an invalid payment card or a card or account to which they have no right to use;
    2. impersonate another person or falsely represent their identity or associations with another person;
    3. violate any rights, laws or regulatory requirements.
  5. In case of booking cancellation by the Service Provider, the Service Provider will order a payment refund within 3 business days.
  6. The refund will be made through the same payment channel that the User used. If it is not possible to make a refund in the same way, the Service Provider will contact the User to indicate a bank account to which the refund should be made.

§ 6 Complaints

  1. Every Customer has the right to file a complaint. A complaint can be filed in written form via traditional mail or email to the Service Provider's addresses provided in these Terms.
  2. When submitting a complaint, one should accurately describe defects in the Service's functioning or in the provision of Intermediary Service.
  3. The complaint will be processed within 14 days from the day of its receipt by the Service Provider.
  4. The Customer will be informed about the result of the complaint procedure in the same way they filed the complaint.

§ 7 Personal Data

  1. Personal data that the User provides to the Service Provider in connection with using the Service are processed in accordance with the principles specified in these Terms and in a separate document – "Privacy Policy", publicly available in the Service.
  2. The personal data controller is Ticketwhat Sp. z o.o. with its registered office at ul. Frezerów 3, 20-209 Lublin, entered in the National Court Register under KRS number 0000809810 and having NIP tax number 9462692646.

§ 8 Final Provisions

  1. The Service Provider has the right to change the Terms, while preserving the acquired rights of Users.
  2. Any disputes that cannot be resolved amicably, arising on the basis of the provisions of these Terms or related to the use of the Service, will be resolved by the competent Polish common court with local jurisdiction for the Service Provider.
  3. The Terms are effective from the day of their publication until revoked.
